\n\nVIARIUM INGENIER\u00cdA, S.L.<\/strong> hereinafter, VIARIUM<\/strong>has enabled the electronic address\ncanal.etico@viarium.es<\/a> como elemento clave e id\u00f3neo para la supervisi\u00f3n, control y prevenci\u00f3n en el \u00e1mbito del cumplimiento \u00e9tico y normativo, con el prop\u00f3sito de promover una cultura de transparencia, \u00e9tica y libre de conductas de corrupci\u00f3n, fraude o incumplimientos administrativos y\/o penales.\n\nEl presente Canal Interno de Informaci\u00f3n se instaura como elemento clave e id\u00f3neo para la supervisi\u00f3n, control y prevenci\u00f3n en el \u00e1mbito del cumplimiento \u00e9tico y normativo, con el prop\u00f3sito de promover una cultura de transparencia, \u00e9tica y libre de conductas de corrupci\u00f3n, fraude o incumplimientos administrativos y\/o penales en la organizaci\u00f3n.\n

Channel scope<\/h2>\nThis channel does not handle customer queries, complaints or claims, nor HR-related matters. For these cases, you should use the channels specifically set up for them.\n

Regulatory framework<\/h2>\nThe channel complies with the provisions of Law 2\/2023, of 20 February, on the Protection of Whistleblowers and Royal Decree-Law 3\/2020, of 4 February, as well as the provisions of Article 31 bis of the Criminal Code regarding compliance, Circular 1\/16 of the State Attorney General's Office, and the case law of the Supreme Court on the matter.\n

What can be communicated through this channel<\/h2>\nThis channel is established as an objective and effective mechanism to inform about:\n

Infringements of European Union Law<\/h3>\nAny actions or omissions that may constitute infringements of European Union law, in accordance with the requirements set out in the regulations.\n

Serious criminal or administrative infringements<\/h3>\nActions or omissions that may constitute a serious or very serious criminal or administrative offence. In any case, all criminal or administrative offences of a serious or very serious nature that involve economic loss for the Public Treasury and Social Security shall be deemed to be included.\n

Internal and Code of Ethics breaches<\/h3>\nRelevant breaches, or well-founded indications of having occurred, of the internal regulations and basic principles of the Code of Ethics and Conduct, which do or do not involve an infringement of the matters set out in the preceding sections or in the field of labour relations.\n

Responsible use of the channel<\/h2>\nThe reported facts must be true. Consequently, the whistleblower must ensure that the information provided is correct and must not use the channel to make false reports, reports that show manifest bad faith, unfounded reports or reports without concrete indications, reports on facts that are not reportable because they do not constitute any type of offence or ethical breach, or reports relating to facts that are already under judicial review.\n

Forms of presentation of communications<\/h2>\nComplaints can be made through this channel or verbally, after a request through this or other established means.\n

Confidentiality and whistleblower protection<\/h2>\nThis channel provides a confidential and secure means for anyone who has dealings with the organisation to report any suspicious or illegal operations without fear of reprisal.\n\nThis channel guarantees the confidentiality of the identity of whistle-blowers, of any third party mentioned in the communication and of the actions taken in the management and processing of communications, taking into account, in all cases, data protection regulations and preventing access by unauthorised personnel.\n

Management and resolution of communications<\/h2>\nAll reports or communications will be answered and resolved as quickly as possible, respecting the legally established deadlines and, in no case, will information be provided to third parties except in cases where legislation so permits.\n

Data protection<\/h2>\nThe record of communications is not public.
