Terms and Conditions for using the website
1. Object and Scope
These Terms and Conditions of Use regulate the access, browsing and use of the VIARIUM Website (hereinafter referred to as "the Website") in addition to the responsibilities derived from the use of its contents. In this regard, the term "Contents" shall be construed as the texts, graphics, drawings, designs, codes, software, photographs, music, videos, sounds, databases, images, expressions and information, and any other creation protected by Spanish laws and international treaties concerning the protection of intellectual and industrial property rights. The term "User" shall be construed as anyone who accesses, browses or uses the services and activities, whether free of charge or for a fee, carried out on the Website.
By simply accessing or merely using the Website implies that the User consents and agrees to the valid Terms and Conditions as published when browsing. The User is therefore advised to read these Terms and Conditions carefully and regularly.
These Terms and Conditions of Use are not intended to govern any contractual aspects relating to the rendering by VIARIUM of its specific services, and are limited to being the legal framework for Website use and access.
2. Website Access and Use
Users may access the Website freely and free of charge.
All information that the User sends us through our Website, e.g., personal data submitted in the "Contact" section, is subject to our Privacy Policy https://viariumgroup.com/politica-privacidad.html In this regard, the User shall be responsible for the accuracy, completeness and truthfulness of information sent and submitted.
The User is the sole and exclusive party responsible for accessing, browsing and using the Website, and therefore undertakes to diligently observe any additional instructions given by VIARIUM regarding the use of the Website and its contents, and not to use the VIARIUM service or its contents in any way that is not expressly authorised by these Terms and Conditions.
By accessing and using the Website, the User accepts the content of these Terms and Conditions.
In particular, the User shall refrain from:
- o Using the contents included on the Website for purposes or effects contrary to the law, morality and generally accepted good customs or public order;
- o Reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying the contents, unless authorised by the owner of the corresponding rights or it is legally permitted;
- o Using the contents and, in particular, the information obtained through the Website for advertising purposes.
- o Providing any personal information about yourself or in connection with your use of and access to the Website that is untrue or has been unlawfully obtained.
- o Causing damage to the physical and electronic systems of VIARIUM, its suppliers or third parties, introducing or spreading computer viruses or any other physical or electronic systems that may cause the aforementioned damage.
- o Attempting to access and, where applicable, using other users' e-mail accounts and tampering with their messages. VIARIUM reserves the right to remove all comments and contributions that violate the respect for the dignity of the person, are discriminatory, xenophobic, racist, pornographic, that threaten youth or childhood, public order or safety or any content it deems to be inappropriate for publication. In any case, VIARIUM shall not be held liable for the opinions expressed by users through forums, chats or other participation tools.
3. Rights of ownership held by VIARIUM
VIARIUM holds all intellectual and industrial property rights on the Website, including the domain name and all content available through the Website. The mere access or browsing of the Website by the User shall never be construed as any sort of transmission, licence, transfer or total or partial assignment of such rights by VIARIUM to the User, who may not use or exploit such rights publicly under any circumstances whatsoever.
The deletion or manipulation of the copyright notice and any other data identifying or recognising the exclusive ownership of VIARIUM's rights in relation to the Website or the protected content found on the Website is strictly prohibited.

4. Liability and Guarantees
VIARIUM manages the Website diligently and therefore endeavours at all times to maintain complete and accurate information on all the services it offers, updating it at all times. However, occasional discrepancies may occur between the information provided on the Website and the reality of the service actually provided. Users are therefore invited to visit the Website on a regular basis.
VIARIUM has taken the appropriate measures at all times, in accordance with the current state of the art available, to safeguard proper Website operation and to prevent the existence of harmful viruses or computer programmes that could cause damage to Users.
However, computer security is not infallible and is exposed to certain risks as a result of the inevitable activity of hackers and virus or malware programmers. - o Viruses or computer programs or any elements designed for cybernetic attack or infiltration of the User's computer systems that may have been inadvertently installed therein, via or as a consequence of the User's access to the Website;
- o The possible vulnerability of the Website and of the security measures adopted therein;
5. Links to Other Websites
The User may find links on the Website to other Applications or Websites operated by third parties, such as, for example: Twitter, Facebook, YouTube or Instagram. VIARIUM has no power to control all the information or content provided by third parties, and therefore cannot accept any liability whatsoever for the quality and reliability thereof, or for the truthfulness or suitability of the content offered therein.
The establishment of any type of link from the Website to another website or third-party Application shall not be construed as any sort of relationship, collaboration or dependency between VIARIUM and the party responsible for that Website or Application.
6. Duration and Amendments
VIARIUM may amend these Terms and Conditions, in whole or in part, by posting any changes in the same manner in which these general terms and conditions appear. VIARIUM shall also make every effort to ensure the continuity of the service and operation of the Website. However, and to the extent permitted by law, VIARIUM may terminate, suspend or interrupt, at any time and without prior notice, access to the contents of the Website, without the User being able to claim any compensation whatsoever, whether due to technical or maintenance difficulties.
7. Severability
If any provision(s) of these Terms and Conditions is (are) declared unenforceable or invalid, the remaining provisions shall remain effective and unaffected by such invalidity.
8. Governing law. Jurisdiction
The present Terms and Conditions concerning this website are governed by the laws and legislation of the Kingdom of Spain, and all pertinent regulations by the corresponding authorities.
Any discrepancy between the User and VIARIUM regarding the validity and enforceability of any provision herein shall be resolved by a court of law in accordance with the rules of jurisdiction established in the pertinent legislation currently in force.
