Purpose of the processing

The personal data that you provide us via our website or any other medium we make available to you may be processed for the following purposes:

Assess your suitability for employment commensurate with the current vacancy as applied or future vacancies;

  • o Job application procedures;
  • o Notification of offers, vacancies and personalised recommendations based on the information provided;
  • o Administrative formalities;
  • o Database analysis to improve our selection process and the search for talent and excellence;
  • o Communication of data to team and project managers seeking professional profiles;
  • o Reporting and dealing with other possible matters required by law or authority.

The user guarantees that the personal data provided to VIARIUM are true and accurate, and VIARIUM shall not be held liable for any incident arising from the inaccuracy or falsity of the information provided.

Data storage criteria:

  • o Requests to join programmes and projects organised or managed by VIARIUM: the personal data collected in this way will be kept for the duration of the programme or project in question. On expiry of this period, the personal data will be kept by VIARIUM should any liability arise with VIARIUM and/or other third parties involved in the corresponding programme or project, as well as when required by the regulatory framework applicable to VIARIUM.
  • o Contracts, agreements or arrangements entered into with VIARIUM: the personal data provided in such contracts, agreements or arrangements shall be kept until the termination thereof. Subsequently, personal data will be kept whenever liabilities may arise with VIARIUM and/or in compliance with other regulatory frameworks applicable to VIARIUM or with a regulation with the status of law that requires the conservation of such data.
  • o Curriculum Vitae Management: as a general rule, VIARIUM will keep your Curriculum Vitae for a maximum period of one year. Upon expiry of this period, they shall be automatically destroyed, in compliance with the principle of data quality.
  • o Miscellaneous: all other data and information provided by the user by any means will be kept for as long as is necessary to fulfil the purpose for which they were collected.
  • o In any case, personal data shall be kept so as to allow the identification and exercise of the Rights of Data Subjects, and under the technical, legal and organisational measures necessary to guarantee the confidentiality and integrity of such data.

Legitimacy for processing

The legal basis that enables VIARIUM to process the personal data of users, donors, beneficiaries and other data subjects is as follows:

  • o The application of pre-contractual measures and the execution of a contract to carry out the processing, management and implementation of any of our programmes or projects.
  • o VIARIUM's legitimate interest in handling any request for information or enquiry about our activities.
  • o Consent given by job applicants for recruitment and selection purposes.
  • o Should you enter into a contract, agreement or arrangement with us, the legitimacy shall be the performance of such contract, agreement or arrangement.
  • o The consent of the data subject to send informational,
  • marketing or promotional offers related to our activities, by e-mail or any other means.
  • o Compliance with a legal obligation to process requests to exercise personal data protection rights.
  • o Compliance with a legal obligation, to manage the communications and/or complaints made by the user through the VIARIUM whistleblowing channel. Recipients

The data will be communicated to the HR department in its capacity as data processor, with registered address at C/ Jacinto Benavente, 2B, 2ª planta 28232 Las Rozas (Madrid), and e-mail address protecciondedatos@viarium.es, and shared with Viarium Group companies and Government Agencies and other Official Entities whenever required to do so by law or court order.

Data will not be transferred internationally to third countries.

Your personal data may also be transferred to third parties with whom a contract is formalised that sets out the obligations and responsibilities that they assume in the processing of the data, in their capacity as Data Processors.

Data provenance

Personal data are collected directly from data subjects and our partners.

Our partners provide us with the following categories of personal data:

  • o Identification data.
  • o Postal or e-mail addresses.
  • o Contact telephone numbers.

No special data categories are processed.

Rights

Right to Access, Rectification and Erasure: data subjects have the right to obtain confirmation as to whether VIARIUM is processing personal data concerning them. Data subjects have the right to access their personal data, request the rectification of inaccurate data or seek their erasure for reasons such as, yet not limited to, the data no longer being necessary for the purposes for which they were collected.

Right to Restriction and Opposition: in certain circumstances, data subjects may request that we restrict the processing of their data, in which case we will only retain the data for the purpose of exercising or defending claims. In certain circumstances and on grounds relating to their particular situation, data subjects may object to the processing of their data. VIARIUM will stop processing the data in this case, except for compelling legitimate reasons, or for the exercise or defence of possible claims.

These rights may be exercised through our Whistleblowing Channel, as explained in the following section.

The data subject must specify the rights to be exercised and, must likewise submit a photocopy of his or her national identity card or equivalent identification document. When represented through an agent, whether legal or voluntary, the data subject must also submit a document accrediting representation and an identification document of the agent.

Whistleblowing Channel

VIARIUM has implemented a Whistleblowing Channel, aiming for the highest commitment, rigour and professionalism in terms of security, experience, independence and knowledge in handling communications received concerning ethics, complaints and communications.

Data subjects may use the Channel to exercise their Rights (see previous section) and communicate any indication or knowledge they may have of possible security breaches and/or possible breaches or irregularities in relation to the Data Protection regulations or this privacy policy.

Data subjects may contact VIARIUM with any questions regarding the processing of their personal data or the interpretation of our policy by contacting our Data Protection Officer (DPO) at the address indicated at the beginning of this policy.

Updates and amendments

VIARIUM reserves the right to amend and/or update the information on data protection, when necessary for the correct compliance with Data Protection regulations. Changes will be posted on this page, which shall always contain the currently valid policy. In any case, relations with users shall be governed by the valid rules when the website is accessed.
